Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Comments on Impact of Ongoing Transvaginal Mesh Litigation on Boston Scientific Corp.

New York, New York (PRWEB) January 30, 2013

Boston Scientific Corp., which is facing hundreds of transvaginal mesh lawsuits filed in the U.S. District Court, Southern District of West Virginia, recently reported that sales of its Women's Health business declined 7% in the fourth quarter of 2012. (In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326) According to a transcript of the company’s most recent earnings call, the decline was due in part to continuing concerns about the use of vaginal mesh devices to repair pelvic organ prolapse.* According to Bernstein Liebhard LLP, concerns about the use of these products are likely driven by recent regulatory warnings and the growing vaginal mesh litigation now underway in both state and federal courts.

“News of serious complications associated with the use of transvaginal mesh has been growing for several years. It’s not surprising that Boston Scientific and other vaginal mesh manufacturers would see an impact,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices.    Firm partner, Jeffrey S. Grand, is serving as a member of the Plaintiffs’ Steering Committee in the Boston Scientific transvaginal mesh litigation underway in West Virginia. Bernstein Liebhard LLP continues to offer free legal evaluations to women who sustained serious injuries, allegedly as a result of vaginal mesh.

Vaginal Mesh Lawsuits
A growing number of women have filed transvaginal mesh lawsuits alleging they experienced serious, painful and life-changing injuries following implantation of these devices to treat pelvic organ prolapse and stress urinary incontinence. Claims have been mounting since July 2011, when the U.S. Food & Drug Administration (FDA) warned that there had been a five-fold increase in reports of serious complications associated with the use of transvaginal mesh. The FDA also modified its previous position on the frequency of such complications, stating in the alert that vaginal mesh injuries associated with pelvic organ prolapse repair were not rare.**

Several other vaginal mesh litigations are pending in the Southern District of West Virginia, including In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“ MDL No. 2327). Partner Jeffrey S. Grand is also serving on the Plaintiffs’ Steering Committees in these proceedings. The first trial in these proceedings, involving a claim filed against C.R. Bard, is scheduled to begin on February 5th.

In addition to the federal vaginal mesh litigations, consolidated proceedings are also underway in New Jersey Superior Court, Atlantic County, involving products manufactured by Johnson & Johnson’s Ethicon unit and C.R. Bard. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10, and In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10). Along with his work on the federal transvaginal mesh litigations, Mr. Grand serves as Co-Liason Counsel in both of these proceedings.

Women who suffered complications following implantation of transvaginal mesh may be entitled to compensation for their medical bills, pain and suffering, and other injuries. Bernstein Liebhard LLP is offering free lawsuit evaluations to any woman injured by vaginal mesh devices.
