As reports of da Vinci surgery complications related to the da Vinci Surgical System continue to mount, Bernstein Liebhard LLP has become aware that a da Vinci robot lawsuit filed in Louisiana federal court was recently settled. According to a notice announcing the settlement entered by Magistrate Judge Daniel E. Knowles III of the U.S. District Court for the Eastern District of Louisiana on March 14th, the Plaintiff in the lawsuit claimed she was injured when the da Vinci robot malfunctioned during a thyroid procedure. Among other things, her da Vinci robotic surgery lawsuit accused Intuitive Surgical of failing to adequately maintain the device, and failing to train hospital personnel on the use of and/or the troubleshooting of the device. Da Vinci Robotic Surgery Lawsuits
According to a report published by Bloomberg.com earlier this month, Intuitive Surgical has been named in at least 10 additional da Vinci robotic surgery lawsuits filed in the past 10 months. The same report noted that the da Vinci Surgical System had been associated with 70 deaths in informal incident reports sent to the U.S. Food & Drug Administration (FDA) since 2009. In January, the agency launched a survey of hospitals that asked doctors who had used the technology to list any da Vinci surgery complications they may have seen. The FDA survey is being conducted to determine if a recent spike in adverse event reports related to the da Vinci robot was indicative of a possible problem with the technology .*

According to Bernstein Liebhard, news of this settlement is likely to further fuel the growing controversy over the use of robotic surgery and the da Vinci robot. Earlier this month, the American Congress of Obstetricians and Gynecologists (ACOG) advised its members that robot-assisted hysterectomy should not be a first choice for women who need the procedure. Among other things, the group cited the technology’s increased learning curve, during which there is a higher complication rate.**

Most recently, Massachusetts’ Bay State Board of Registration in Medicine has issued a new advisory for robotic assisted surgery.*** According to the alert, the Board chose to act after it received an increasing number of reports of patient complications associated with robot-assisted surgery in the past two years. While the alert didn’t specifically mention da Vinci surgery complications, according to a report from MassDevice.com, the da Vinci robot is the market leader in robotic surgery procedures, with about 367,000 U.S. operations performed in 2012.****
